This Privacy Policy for Personal Data (hereinafter referred to as the "Privacy Policy") applies to all information that the website of Idea Digital Agency (hereinafter referred to as the "Agency"), located at the domain name ideadigital.agency (including its subdomains), may obtain about the User during their use of the website ideadigital.agency (including its subdomains), its programs, and its products.
1. Definition of Terms

1.1.6. "Subdomains" – pages or collections of pages located on third-level domains belonging to the website Idea Digital Agency, as well as other temporary pages with the Administration's contact information at the bottom.
1.1.7. "User of the website Idea Digital Agency" (hereinafter referred to as the "User") – an individual using the information and materials of the website Idea Digital Agency.
1.1.8. "Cookies" – a small piece of data sent by a web server and stored on the user's computer, which the web client or web browser sends to the web server in an HTTP request when attempting to open the corresponding website page.

2. General Provisions

3.2. Personal data permitted for processing under this Privacy Policy is provided by the User by filling out forms on the website Idea Digital Agency and includes the following information:

6. Rights and Obligations of the Parties
6.1. The User has the right to:
6.1.1. Freely decide to provide their personal data necessary for submitting requests on the website Idea Digital Agency and consent to their processing.
6.1.2. The User has the right to obtain information from the Administration regarding the processing of their personal data, unless such right is restricted by law. The User may request the Administration to clarify, block, or destroy their personal data if the data is incomplete, outdated, inaccurate, unlawfully obtained, or unnecessary for the stated processing purposes, as well as take legal measures to protect their rights.
6.2. The Administration is obliged to:
6.2.1. Use the obtained information solely for the purposes specified in clause 4 of this Privacy Policy.
6.2.2. Ensure the confidentiality of confidential information, not disclose it without the User's prior written consent, and not sell, exchange, publish, or otherwise disclose the User's personal data, except as provided in clauses 5.2 and 5.3 of this Privacy Policy.
6.2.3. Take precautions to protect the confidentiality of the User's personal data according to the procedures generally used to protect such information in existing business practices.
6.2.4. Block personal data related to the respective User from the moment of the User's request or inquiry, or their legal representative or authorized body for the protection of personal data subjects' rights, for the verification period, in case of inaccurate personal data or unlawful actions.
7. Liability of the Parties
7.1. The Administration, which fails to fulfill its obligations, is liable for losses incurred by the User due to the unlawful use of personal data, in accordance with Ukrainian legislation, except as provided in clauses 5.2, 5.3, and 7.2 of this Privacy Policy.
7.2. In case of loss or disclosure of Confidential Information, the Administration is not liable if such confidential information:
7.2.1. Became public before its loss or disclosure.
7.2.2. Was received from a third party before it was received by the Administration.
7.2.3. Was disclosed with the User's consent.
7.3. The User is fully responsible for compliance with Ukrainian legislation, including advertising laws, copyright and related rights protection laws, trademark and service mark protection laws, and others, including full responsibility for the content and form of materials.
7.4. Regarding text materials (articles, publications freely available on the website Idea Digital Agency), their distribution is permitted provided that a link to the Agency's website is given.
7.5. The Administration is not liable for any direct or indirect losses resulting from: the use or inability to use the website or certain services; unauthorized access to the User's communications; statements or behavior of any third party on the website.
8. Dispute Resolution
8.1. Before filing a lawsuit in court regarding disputes arising from the relationship between the User and the Administration, it is mandatory to submit a claim (a written or electronic proposal for voluntary dispute settlement).
8.2. The recipient of the claim must, within 30 calendar days from the date of receipt, notify the claimant in writing or electronically about the results of the claim review.
8.3. If no agreement is reached, the dispute will be referred to the Arbitration Court of Kyiv.
8.4. Current Ukrainian legislation applies to this Privacy Policy and the relationship between the User and the Administration.
9. Additional Terms
9.1. The Administration has the right to amend this Privacy Policy without the User's consent.
9.2. The new Privacy Policy comes into force from the moment it is posted on the website Idea Digital Agency, unless otherwise provided by the new version of the Privacy Policy.
